WE DO NOT WARRANT THAT AUTH.PLA.SH WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT AUTH.PLA.SH OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF AUTH.PLA.SH, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF AUTH.PLA.SH WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
You agree to indemnify and hold harmless Us and our officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with Your access to or use of auth.pla.sh, Your violation of these Terms, or Your violation of any rights of another.
9.1 Binding Arbitration
Any dispute arising out of or relating to these Terms or pla.sh shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration will be conducted in Delaware, unless You and Us agree otherwise. We have the right to choose a neutral arbitrator for the party. Each party will be responsible for paying any filing, administrative, and arbitrator fees in accordance with AAA rules.
9.2 Class Action Waiver
YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST ANSWERDOTAI, INC. ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
9.3 Exceptions
Notwithstanding the foregoing, You and Us may seek injunctive or other equitable relief to protect intellectual property rights in any court of competent jurisdiction.
These Terms and any dispute arising out of or related to these Terms or auth.pla.sh shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice of law or conflict of law provisions.
